Chandigarh/GURGAON: The Punjab and Haryana high court on Friday dismissed a bunch of petitions holding up construction of the Dwarka expressway, taking the long-delayed project past another major hurdle.

The petitions concerned a 1.3km stretch of the expressway in Gurgaon near New Palam Vihar, where a settlement was reached in May between HUDA and 350 families who will be displaced by the project. While that had helped free a 2.5km area from litigation, Friday's verdict cleared a contiguous stretch, paving the way for construction to begin.

But not all legal hurdles before the project are gone. A lawyer representing some of petitioners said a few more pleas remained to be heard by the court.

While dismissing the pleas, the high court allowed the petitioners to construct houses in the sectors developed by HUDA according to the settlement. HUDA has offered to resettle the petitioners in sectors 37C and 110A. To facilitate construction, the state government had framed a resettlement plan in consultation with families in and around New Palam Vihar. Most families accepted it, leading to the breakthrough in May, but some refused to budge. The high court subsequently granted them time to dwell upon the proposal again before dismissing their pleas on Friday.

The Dwarka expressway, or Northern Peripheral Road, is an 18km long artery that will serve as an alternative link between Gurgaon and Delhi and is expected to ease traffic on the existing expressway. Land for the road was acquired in 2008-2009. Construction of a major portion of the Dwarka expressway has been completed. Several housing projects have also some up in the area.

Rajesh K Gouri, vice-president, Homestead Infrastructure, said "This decision is welcomed not only by us as builders but also by common people who have invested their money in different projects along Dwarka expressway. This will bring cheer in the market and benefit builders as well as investors."

now, With Major Hurdles Cleared, if all the Builders can get together do the Following, Things can get really hot on DREAM EXPRESSWAY.

            1. Push Indiabulls to speed up the DEW Construction, possibly ROB in SEC 99, should have been done by End of Year.

            2. Get MCG / HUDA / DDA to complete the Basics : Water, Electricity, Sewer Lines to be installed fast.

            3. Ask CM to expedite the plans for DEW - METRO.

            4. Get the Allotments for Hospitals / Schools / Hotels Etc on DEW Stretch thru open and transparent Bidding done ASAP.

Any more delays will kill Investors interest, who have been earning only FD Grade Returns in Last 3 Years, inspite taking Huge risks.

Make DEW the FIRST SMART CITY without need for Government.

            MINIMUM GOVERNMENT. MAXIMUM IMPACT.

Dwarka Expressway gets high court stamp

The northern periphery road (NPR), also known as Dwarka Expressway, connecting Dwarka with National Highway-8 got the Punjab and Haryana high court stamp on Friday.

The high court division bench of justice SK Mittal and justice HS Sidhu dismissed the remaining five petitions filed by the affected parties challenging land acquisition for the 18-km-long and 150-metre-wide road.

Conceived in 2007, the road cutting through residential blocks was sanctioned to decongest the snarl-plagued Gurgaon Expressway. The road will allow traffic from the Jaipur side to skip the Gurgaon Expressway and head straight towards Dwarka and Indira Gandhi International Airport.

A 16-km stretch was ready and the work on the remaining 2-km section was initiated following a May 2015 order whereby stay on the construction of the stretch was vacated by the high court. The high court order had come following the government's submissions that a good number of petitioners had accepted its rehabilitation plan.

The remaining five petitions dismissed on Friday are those of nearly 100 families and a few industrial units of Kherki Daula village, also part of this remaining 2-km road, who had turned down the government's rehabilitation offer in May.

These petitioners had argued that alignment was changed by the government and sought modifications in it. They had also argued that land was acquired by invoking urgency provisions, which was not a case anymore.

On the other hand, the Haryana government had argued that other projects had been planned keeping in mind the alignment of the road. Hence, at this stage, it would not be possible to make amendments, additional advocate general Amar Vivek said.

Though a detailed order is awaited, the court dismissed the petitions while rejecting their contentions, he added. As of the rehabilitation package to these families, Vivek said: "In spite of the court orders, if they accept the rehabilitation plan in next 10-15 days, the government is ready for a dialogue outside the court."

                Nice wish list.
But why would builders comply they have already taken more money than actually spent. So they would be at a loss if they hurry in delivering projects.

Ramratanji - your views are absolutely feasible. Only you should allow a little more time, if possible.

Pls. find the status of all the HUDA projects concerned with NPR and New Gurgaon. most of them are going on. with the clearnace of the litigation, now all eyes are on the people moving out and the earthmovers rolling in. Hopefully in January 2016 we should have major breakthrough.

Also the status of all the small hindrances are also listed out, pls. see that there are some haryana depts also which are the cluprits, now with the big things getting sorted out, all the small issues will vanish, as there is apparently major push from CM's office directly. Anita Yadav is under direct orders from the CM and the Finance secy. to make sure every paper is cleared expeditiously.

Now as regards schools, hospitals and market places, these will start only when the road is complete and builders start giving out possessions. some commercial places which are under construction (aashu had given a list earlier) will be ready, but the main commercial stretches are still unauctioned/unallotted.

Schools would be first to start coming up, followed by other amenities, once the road is operational.
