HARYANA HIGH COURTY- DRINKING WATER RIDER FOR FLATS

    TNN | Jan 10, 2015, 04.35 AM IST

CHANDIGARH: The Punjab and Haryana high court on Friday restrained the Haryana government from issuing occupation certificates to builders from sectors 68 to 80 in Gurgaon till a permanent solution was found to builders selling homes without ensuring basic amenities.

The court directed the Haryana government to prepare details of all residents of these sectors, their daily requirement of water, and the source from which sufficient water can be supplied to them. The high court made it clear that till the blueprint for drinking water supply to these 13 Gurgaon sectors was not ready and presented to it, state authorities should not issue occupation certificates to the builders.

While issuing the orders, the HC observed that state government was busy generating revenue by selling colony licences to builders, who were least bothered about providing basic facilities like water to residents.

The Haryana chief secretary and the chief administrator of Haryana Urban Development Authority (HUDA) were present before the court. The orders were passed while the court resumed hearing of a petition filed by Mukesh Sharma, a resident of Silokhra village of Gurgaon district, who had accused builders of illegal extraction of groundwater.

When the state authorities informed the court that efforts were being made to provide water to residents of these sectors from borewells and water tankers, the bench observed, "How long will residents survive on water supplied through tankers?"

Further hearing on the case has been fixed on February 10, when the state government has to submit the blueprint before the court. Earlier, on January 5, the Gurgaon deputy commissioner had submitted before the high court that the administration had constituted 22 teams to check illegal groundwater usage. He said after inspections by the teams, 910 borewells had been sealed.

It was further stated had been found that around 157 borewells had been installed by construction companies which had been given no objection certificates by the Haryana department of town and country planning (DTCP). The DC further said recommendations were made to the DTCP director general to cancel the licences of such builders.

Meanwhile, the petitioner has sought directions to take action against defaulting projects which were grossly violating Environment Protection Act norms and various notifications relating to illegal extraction of groundwater for construction in Gurgaon. The petitioner had conducted sting operations showing the misuse of underground water by builders, and submitted a CD of video recordings of the same before court.

HUDA SDO Subhash Piplani said there are eight occupied buildings in Sectors 68-80. "There are three commercial buildings and five residential properties. They are currently being supplied water via tankers from our boosting station in Sector 16," said Piplani.

  • HUDA to submit water supply plan for new sectors to HC
    Page 1 of 4
GURGAON: Urban development authority HUDA has drafted a new plan to supply potable water to 13 new sectors where the Punjab and Haryana high court has kept occupation certificates of flats on hold till the requisite infrastructure is put in place.

The high court had, on January 9, asked the government and builders to find a permanent solution and asked for a blueprint of drinking water supply to the 13 sectors (68-80), where 124 new housing and commercial licences have been issued. The orders were passed during the hearing of a petition filed by Mukesh Sharma, a resident of Silokhra in Gurgaon, who had accused builders of illegal extraction of groundwater.

HUDA's superintendent engineer-I AK Gupta told TOI there were six hurdles in the way of extending the water supply network to the new sectors. These include hindrances to laying new lines connecting the water treatment plant at Chandu Budhera to the sectors as well as pending land acquisition and litigations.

  • HC seeks water solution for new sectors in Gurgaon by February 25
    Feb 15, 2015,
GURGAON: The Haryana Urban Development Authority`s alternate plan for water supply to new sectors (from 68 to 80) has hit another roadblock with the Punjab and Haryana high court rejecting its proposal. The HC has now asked HUDA to come up with a new plan by February 25. Earlier, the court had asked HUDA not to issue occupation certificate to builders till it could ensure water supply for all residents.
On February 10, HUDA officials submitted a plea before the HC highlighting major hurdles in proving water supply to new sectors. According to a senior official, most crucial roadblock in providing clean water through pipeline to new sectors is about 350 meters of land along the Southern Peripheral Road (SPR) which is stuck in litigation. HUDA informed the court that if ruling in the SPR litigation was in its favor, a pipeline could be laid to supply water to new sectors. Otherwise, it would take four years to build a pipeline from Chandu Budhera water plant to new sectors crossing NH-8. The court pulled up HUDA officials for suggesting that if one court decision was not in their favor, the residents would have to live without water for four years. The court said HUDA must come up with a credible solution by February 25. When asked, HUDA administrator Anita Yadav said, "We are trying to talk to the residents of the hamlet near Fazilpur and trying to work out an amicable solution. Superintendent engineers are working on a strategy and should be out with a workable solution soon."
