Is the Buyer or the Seller Liable to Pay Maintenance Chargers?

    We had booked a flat in 2010 in Gurgaon and paid according to the payment plan but wanted a little bigger apartment.Now we had a buyer who was interested and who made initial payments for the flat and made final payment after 45 days.Now after all the transfer and clearing our dues, the transfer of property states that the seller clears all the dues and the buyer clears maintenance charges in the affidavit. Now the buyer after all the deal has been made is saying that the seller needs to pay the initial days of the maintenance as the maintenance started from April 1 to 21 st July while the builder was still making the flats.

    We are purchasing a bigger apartment in the same locality /complex and the seller also is not willing to pay the maintenance. As per the agreement the buyer knew about the payment of the maintenance and the dues which we were to clear. During the transfer at the builders office we cleared the interests and final payments. According to the dealer after the transfer of property before registry/sale deed we are not obligated and the buyer knew about the amount to be paid in these 45 days. Shouldn't it be the builder and buyer problem . Our seller is also not going to pay the maintenance charge when we will transfer the property in our name.

    The buyer now is threatening us that he will take legal action if we do not pay up pay up

    I understood that it's liability of seller until the property is transferred to new buyer.

    By the way what amount is due from 1, April to 21st July....

    It is liability of seller to clear the maintenance charges if builder is asking for until the transfer of the property.
