Hi All,

As has been happening for the last few days, Allahabad HC has begun putting stay orders on projects in NE. While I understand that this is currently happening in NE which was always risk-prone, still other areas of Noida can easily start coming into this ball of fire. This also includes sectors 7x and 1xx since the point of contention currently is the way in which the land was aquired and if the land use was changed from Industrial to residential.

Please note that we cannot get this information from our respective builders because they would show us their Lease agreement and other documents and not anything beyond that. I am sure most of us (belonging to IT, etc) would not even be able to decipher if the papers they are showing are the proper papers or not. In some cases, it might even happen that the builder papers are complete but still we run into trouble since the problem lied at NA end.

So the problem might not be at the builder end, but still we end users would suffer for not apparent fault of ours. Also, since most of us must have taken CLP or Flexi plans, the sooner we get to know about the real scene, the better it would be for us.

My question to you is :
1) Can we form a group and file an RTI seeking information for the land aquisition details in these sectors ?
2) Some of us may be working as Lawyers or in the Press or some Govt Agencies and using their credentials if they can get internal information from Noida Authority itself.

    Just read news reports in HT. yesterday protest was a damp squib!!. Farmers of 7X sectors just have "one demand"- they should be given their plots under 5% abadi". Noida authority has given plots only to those farmers who did no unauthorized constuction on their land(around 30%) rest 70% farmers are still awaiting for their plots. This case is entirely different from NE where farmers had not even accepted the money being offered by GNIDA. So please stop spreading unnecassary panic and also BMW can't afford any other mess in NOIDA so all those who have bought flats in 7X relax there is no need to listen to rumors and get panicky.

    शाहबेरी और पतवाड़ी गांवों को लेकर कोर्ट के फैसले का असर अब नोएडा तक पहुंच गया है। इमरजेंसी क्लॉज के जरिए अधिग्रहित हुई जमीन किसान अब वापस मांग रहे हैं। किसान अथॉरिटी द्वारा बिल्डरों को बेची गई कीमत का 50 पर्सेंट मुआवजे लेने की डिमांड कर रहे हैं। इसके अलावा सभी गांवों की आबादी को 'जैसी है-जहां हैं' के आधार पर छोड़ने और कोर्ट में आबादी संबंधी मामलों का निपटारा करने की मांग की है। नोएडा के किसानों ने अब अथॉरिटी के खिलाफ आरपार की लड़ाई का ऐलान किया है।

    बुधवार को सौहरखा, सर्फाबाद, सालारपुर, ककराला, भूड़ा और बरौला आदि गांवों के किसान सुबह से धरने पर बैठ गए हैं। इस इलाके की जमीन पर सेक्टर- 74, 75, 76, 77, 78, 79, 115 और 117 में बड़ी संख्या में प्राइवेट बिल्डर फ्लैट बना रहे हैं। किसानों के धरना-प्रदर्शन के चलते ज्यादातर साइटों पर काम रुका रहा। शाम को बिल्डर्स के प्रतिनिधि मंडल ने अथॉरिटी के चेयरमैन से मुलाकात की। धरना शांत कराने गए अथॉरिटी के ओएसडी अजय श्रीवास्तव की बात मानने से किसानों ने इनकार कर दिया।

    सोरखा तो शुरूआत है

    सोरखा गांव के अलावा अन्य गांवों के किसान भी अब कोर्ट जाने की तैयारी में हैं। गढ़ी चौखंडी, होशियारपुर, सदरपुर, शाहपुर, नगली वाजिदपुर आदि गांवों के किसान अगले कुछ दिनों में हाई कोर्ट में याचिका दायर करेंगे। गुरुवार और शुक्रवार को पंचायत कर बिल्डरों द्वारा कराया जा रहा निर्माण कार्य रोका जाएगा। अधिग्रहित हुई जिस जमीन पर निर्माण कार्य नहीं हुआ है, उसे किसानों के हवाले किया जाए। किसान संघर्ष समिति के अध्यक्ष दलबीर यादव ने कहा कि सिटी सेंटर के अलावा सेक्टर 71 के आसपास बड़े पैमाने पर खाली जमीन है, जो किसानों के हवाले की जाए। उनका कहना था कि आबादी मामलों का निपटारा शासन द्वारा तैयार नियमावली के आधार पर किया जाना मान्य नहीं है। समझौते और मूल निवासी की जमीन पर बना निर्माण आबादी में दर्ज करना होगा।

    अब ऐसे नहीं मानेंगे किसान

    सौरखा गांव में किसानों के आंदोलन से ग्रेटर नोएडा और नोएडा एक्सटेंशन की तरह यहां के प्रॉपर्टी मार्केट पर असर पड़ने के आसार बन गए हैं। जिले के सबसे बड़ी जमीन वाले इस गांव में करीब 52,000 बीघा जमीन है। किसानों के अनुसार , गांव की 800 एकड़ जमीन टेक्निकल फॉल्ट के चलते राज्य सरकार में निहित हो गई है। 1993 से किसान अथॉरिटी और डीएम ऑफिस के चक्कर काट रहे थे। सौरखा में 2007 में किसानों को 421 रुपये प्रति वर्ग मीटर का मुआवजा मिला था। जिसे अथॉरिटी ने 20,700 रुपये प्रति वर्ग मीटर पर बिल्डरों को बेचा है। किसान 10,350 रुपये का मुआवजा मांग रहे हैं।


    ये हैं किसानों की मांगे

    - आबादी मामलों का निस्तारण किसानों के हितों को ध्यान में रखकर करें

    - मुआवजा नहीं लेने वाले किसानों को जमीन वापस दी जाए

    - जो मकान जहां बना है उसे आबादी मानते हुए छोड़ा जाए

    - एक्वायर होने वाली जमीन की एवज में 5 पर्सेंट प्लॉट अलॉट किए जाएं

    - जिस रेट पर किसानों की जमीन अथॉरिटी ने बिल्डरों को दी , उसका 50 पर्सेंट मुआवजा दें

    - टेक्निकल फॉल्ट के चलते ली गई 800 एकड़ जमीन दोबारा किसानों को दी जाए


    बस यही है विकल्प

    सौरखा ग्राम प्रधान नरेश यादव के अनुसार , आबादी का समाधान किसानों के हित में होने और राज्य सरकार में जबरदस्ती निहित हुई 800 एकड़ जमीन का मुआवजा 50 पर्सेंट या आसपास हो।


    3 महीनों में खत्म होगी समस्या

    अथॉरिटी के नए चेयरमैन बलविंदर कुमार ने बताया कि किसानों की आबादी संबंधी समस्या खत्म करना प्राथमिकता है। सर्वे के आधार पर पहले चरण में चुने गए 11 गांवों की समस्या 10 दिनों में दूर हो जाएगी। सभी 54 गांवों के आबादी संबंधी मामलों को अगले 3 महीनों में निपटा लिया जाए गा।

    What members on this forum has done is not called creating panick.....Filing RTI is the best way to clear out rumors.....It's you who are creating confusion.....one can not sit on his a** when neighborhood is on fire......Once RTI is out everything will be clear.

    Noida Extension Issue:

    1. Problem in Noida Extension is due the EMERGENCY CLAUSE used by GREATER Noida Authority to acquire land from the villagers for INDUSTRIAL purpose and sold to Builders for RESIDENTIAL purpose.
    2. Villagers in Noida Extension are demanding their land back.

    1. Noida Authority has NOT used EMERGENCY CLAUSE to acquire land from villagers
    2. All the sectors in Noida 74/75/76/77/78 etc are acquired for RESIDENTIAL purpose only
    3. AIMS MAX GARDENIA and NOIDA Authority has all the required LEGAL documents with them which can be produced in court, whenever required
    4. Noida Authority had invited formal BID's from the Builders who are interested in developing Sector-75 as a complete project (I have a PDF copy of this BID with me)
    5. AIMS MAX GARDENIA as a consortium has won this BID to develop Sector-75
    6. Here the FARMERS are demanding Revised Compensation and NOT the Land
    7. Today 21-July-2011 work in Golf City and in nearby projects in other Sectors is in FULL Swing.

    Rest we all should not loose our patience and let us be confident of your decision to invest in Golf City. Lets hope for the best!!!!!!!!!"

    CEO and other officials of NA/GNA have gone on record that all land in Noida / GN in has been acquired using emergency [provisions in last 5-6 years

    The bid document attached by you clearly mention that nearly half of Golf City sector 75 land is yet to be acquired. Pls read before making claims. For this reason only there is no registry for entire land and farmers stopped work in last May.

    Builder and Authority nexus is creating all problems. Remember, there was a 40 odd acre city park right behind golf city. Overnight, the master plan was changed and the same land was allotted to Supertech (sector 74) by corrupt authority. If some one goes to court now, superteck cap town could be in serious problem.

    Gardenia Itself very confuse in statements, Nothing is clear. FSI sold by gardenia is still pending Eg. JMD Avnue -75 commercial which never came even after a launch.
