  • This is in regards to the Application filed by Jaiprakash Associates Ltd before Company Law Board, New Delhi Bench u/s 74(2) of the Companies Act, 2013, primarily seeking exemption from the requirement of maintaining liquid assets under Rule 3A of the Companies (Acceptance of Deposits) Rule, 1975/Rule 13 of the Companies (Acceptance of Deposits) Rule, 2014; permission to utilize the funds kept aside for repayment of outstanding Deposits; permission to repay the existing deposits in accordance with the original terms and tenure as accepted by such Deposit Holders, instead of repaying all outstanding deposits by 31.03.2015, and the time of 2 months since 31st May 2015 to clear all the deposits fell due for repayment on or before 31st March 2015 as per their original terms of acceptance.
    Order passed: The Hon’ble Bench grants 6 months since 31-03-2015 to the company to comply with section 74(1) of the Companies Act, 2013 in relation to FDs maturing after 31-03-2015. It means within 6 months after 31-03-2015, company is instructed to repay all deposits which are not even due for maturity.
    Secondly, the company is given extension of 30 days since 31-03-2015 to clear all the deposits due for payment by 31-03-2015.

    Also Unlike what one of the posters said, this makes much more economic sense as it will connect GN and all of the Eway sectors with all commercial development along the Eway, which will be much more than the internal sectors, which will be primarily residential or mixed land use, but people still need to travel to commercial areas to work, so anything transport that connects commercial areas with residential areas will be a big economic hit.

  • I don't think that NGT clearance is done yet. Wait and find more about it before making the payment. Builder is saying whatever it could to get money out of the buyers.

  • The terms are quite confusing for layman like us. But what I know is that the whole process of notification, objection and finalization of draft is done and there is no impact on any residential project for now. This one is waiting the final node and to be passed as law...

    So in a way clearance of possible issues has happen, just a matter of time to be formalised on paper...before OC and registry starts happening.

    Agreed but some pockets continue to languish. Eg, Orchards, Kube are the 2 projects I know of. There may be more.

    Jaypee has sold these 2 projects with full page ads of L&T construction partner and if L&T is not there it is a big setback.

    I see the great potential of WT but am not happy to have invested in WT.
