My Son Late Sumit Mishra has Purchased a Flat no L-0304 with Builder "Today Homes Noida",in their Project Ridge Residency,Sector-135,Noida in March 2011 under CLP.Unfortunately my son expired in Feb 2012 due to illness & I being only Class I Legal heir flat to my unmarried son requested the builder Today Homes to transfer the Allotment of above flat in my name & submitted documents on Noida Authority pattern.The builder asked me for a SUCCESSION CERTIFICATE citing Noida Authority guidelines.On enquiring from Authority website & personally,they said no such guidelines about requirement of succession certificate are ever given to builders & even Noida Authority transfers a registered flat based on Indemnity Bond/Affidavits/NOC etc if the transfer is within blood Relatives.Mr. Anand Kumar who is Office superintendant to Mr Jai Prakash,AGM Housing(:09582793018) ,Noida Authority even spoke to Mr Amandeep Gill,(CRM Today Homes,:09873155558)& with Mr Lokesh Patodia(Legal Head,Today Homes,:09811052937)on wednesday 26th june 2013 & asked them to amicably resolve the issue.He further asked that The Builders may seek directions from Noida Authority about guidelines,if required. We again approached Today Homes Office at B-21,Sector 2,Noida on 26/june/2013 where the Staff just fooled us & asked us to come on saturday.when my son Amit Misra visited them again,they just reacted like Policeman & asked me that neither they will give me in written that they require succession certificate & not the Authority,nor will they transfer without succession certificate.we are deeply humiliated by their inhuman approach & therefore request you to kindly highlight this Adamancy & Arrogant Behaviour of Today Homes Group. we have already paid rs 22 lacs from our pocket & Rs 5.5 lacs had been paid by My deceased son. The cost of making a succession certificate is about 55000 & being solely dependent on our elder son,we are unable to bear such financial burden. Kindly highlight this issue as a lot of Hard Earned Money gets wasted due to such bogus demands of Builders.
These Builders ACT LIKE BEGGARS when selling a Project & as a POLICEMAN when they sold it.
Kindly put this clause that Noida Authority pattern will prevail regarding Transfer of Allotment in all the Agreements you sign with Builders in Noida region as this will help you a lot & you will not have to run from Pillar to Post like me.

  • I am very sorry for your loss. And you are very right in your dealings. However - if I may, I would request that u do get a succession certificate or legal heir certificate prepared.

    In property related matters - this generally is always needed

    Please also check if your wife is also class I in this case.

    The certificate is quite easy to make - pls go to ur local sub-registrars office and speak to some lawyers outside.

    Edit - I just saw u wrote it takes 55000 to make this certificate - are u certain. I dont remember how much this cost us but it was not more than 3-4 thousand.

    Iam really sorry to know about you loss.

    Now coming to your present problem. Kindly follow given steps to get succession certificate.

    1) Visit Noida authority office main entry.
    2) You will see many lawyer sitting near the main entry.( Lease did writers etc)
    3) Tell any one of them that you need Varisan certificate ( succession certificate).
    4) He will tell you details about some paper work, quiet simple.
    5) The total cost should not be more than 2000~5000 ( including the under table money)
    6) You should get that certificate with in one month.

    I just checked - we had gotten a legal heir certificate n not succession certificate which does cost a lot.

  • YUP.Legal Heir certificate is a low price affair but Today Homes is interested in spoiling big money from my pocket through they know that we the parents of late sumit are more than 60 years & not earning.& yes I am MOTHER to late Sumit
