    Thanx for valuable inputs dear. My view is quite similar about e-way. Since it will be a development which is much later in time, will of course be better.

    I agree this is a thread for Lotus Panache, but, at the same time, Lotus Panache too is part of e-way projects and cannot be seen in isolation. Hence, discussing that aspect should not be of any harm. Rather, any input would only add to our knowledge.

  • Ref. Service Tax issue

    I have learnt that the service tax would be leviable on all payments made to a builder after 1.7.2010 (even if booked earlier).

    It would be 2.75% of the payment that we make. Little doubt is whether it would be on the basic cost of flat or on other charges such as parking, club, plc also

    However, those who have booked on down payment basis before 1.7.2010, CHEERS. You are not required to pay service tax as you have already paid the entire sum.

    This info is from a private source and not 100% confirmed.

    Suggestions/comments solicited.

    U are correct. It will be a huge burden on small Buyers like us who will have to pay 2.75% service tax out of the total cost of flat .
    I suppose most of us have not paid more than 2 installments.
    Can u confirm that this service tax guidelines has been approved .

    It is government tax and applicable to all builders. Service tax doesn’t depend when you booked flat. It is applicable for all payments made after 1st July 2010 for under construction property. Even if someone bought property in Year 2008 and getting possession in Dec 2010 and needs to pay Rs 5 Lakh on possession then this 5 Lakh will have service tax.
    From last 6-8 months every builder is writing this thing in all booking forms/allotment letters but it was implemented by government on 23rd June and even till 1st July 2010, it was not clear to lot of people that how it will be implemented.

    As of today, 2.58% service tax will be applicable on basic cost.
    As you can read that effective from 1st July 2010, all payments given to the builder will be consider under service tax. By going through different links on internet, these are the things:

    1. Adding PLC/Few other charges can save little bit money, For example a fix % of BSP will go as land cost and there will not be any service tax on that but for charges like PLC, there will be 10.3% service tax and it won't come under cost of land. For example, if BSP is Rs 2000 and PLC is Rs 200(first floor + park facing) then adding that will make BSP as Rs 2200, now if land cost is 25% by government then in first case, service tax payable will be on Rs 1500 + Rs 200 (PLC) = Rs 1700 but in second case, service tax payable will be on Rs 1650 (25% of 2200) so it will save little bit money. Similarly way adding other costs where service tax will be payable, one can save money.

    2. As per this notification, all money given by buyer after 1st July irrespective whether person booked 2 years before or 2 days before will come under service tax rules.

    3. Until there is no solution, it seems that cost of flat will be around 5% more however in my view, very soon you will see advertisement by builders where they will say that "zero service tax" or "Price includes service tax".

    I got a message today, quoting
    "Most awaited Budget Homes from 3C's on Noida Expressway in just 22.75 Lacs(all inc)"

    is it sector 107 project (LB-2) or some else, but how is it possible cheaper from LP.???

    Just got a call from one broker, that they are launching a new project in Sector-141, and it wud be budget homes.
    Booking will open in 10-15 days.

  • It should be Sector 168, opposite Sector 137 on the other side of e-way. Not sure whether it is budget homes or a normal project.
