    pray this must be first and last case

    If other builders have also used supertech footprint for not maintaining approved towers floors and distance between two towers then such letters may be seen from other builders too with in a very short span of time, we all pray this must be first and last case.

    As per National Building Code, the minimum requirement of distance between two buildings is 9 mtr and mandatory distance of 16 metres between the new towers and their building block.

    Q-What may happen in present scenario suppose many other builders would have violated tower distance or tower floor rules.
    Assumption-Builders may join two adjacent towers and declare them 'One" !! and the cost to join them may be passed on to "once again" on the buyers (who may be punished without any mistake).....and acceptance from buyers may be taken in advance by sending such letters.

      How can builders assume that they will take such blanket approvals from buyers without any one raising their voice.

        On BBA, I can only say what has happened has happened.

        Situation is different here, buyers are raising voice and are in numbers.

        People are forming group in very early stage, even in pre launch.

        One example is Greenopolis by 3C in ggn. Buyers fought and got super area increase clause amended.

        So, now when we know, we can fight wrongdoings and get justice, we must oppose all illegal methods.

        Don't look back and keep blaming why didn't we oppose BBA.

        Also, all buyers ask for is delivery in reasonable time and non plan changes. But greed of builders is at peak right now and they need a hit.

          Buyers need to read up and be reasonably thorough with rules and regulations.
          Do not sign blindly.You spend 60-100 lakhs on a flat-Spend rs5000 on legal advice.This 5000 will help you to realise the pitfalls if any in the agreement.
          Do not invest in financial instruments you dont understand,similarly do not buy a flat till you read the fine print,history of builder and all legal aspects surrounding the project.
          Educated and active buyers who are ready to act in concert to protect their legal interests is the best thing which can happen.This buyer group action will be more useful than relying on government to introduce RE bill to save us.
          You have to save yourself,do not depend on the builder and government to really protect you.

              Such bba will not stand in court of law if it can be proved that builder created pressure situation to get them signed

                  Agreements made under duress wherein one party has an unfair adwantage or upper hand cannot stand up in court of law.In this case both points are applicable agreement being forced upon buyers(under duress) by builders (having unfair adwantage and exploiting the same).Laws of the land prevail not what is written in BBA.Every BBA is subject to UP Apartment Act irrespective of what is written in it.

                    But those who are already bought flats 2 years back how can they protect themself. Is the builder is sending any additional paper to sign for advance consent of up appartment act 2010 please advise?

                      Sinmply do not sign and ask him to provide a other necessary documents first.

                      Al, as per my research and discussion with lawyers this document sent by supertech is also illegal.

                      Court had set guidelines for layout plan changes in very detailed manner. Getting this signed doesn't ensure autocracy by developer.

                      To amend any plan, he need to send letters to conduct voting, submit to authority and authority to publish notice in two national daily.

                      So builder can't take blanket approval. All he need is objection from buyers to ground such evil plans.

                      I wish 3C does such stupidly.
