    Aditya Garden residents to move court against builder

    Residents of Aditya Garden housing complex in Warje have decided to move the consumer court against their builder, SB Kataria, for failing to honour his commitment as per a 'water affidavit' filed with the PMC.

    Ever since they came to reside at this complex of 1,200 apartments about three years ago, the residents have been dependent on water tankers and have not been getting adequate water supply from the PMC in spite of paying water tax. The housing society's expenditure on water tankers has now risen to an astounding Rs1.5 crore annually.

    Residents Pravin Dhakane and Aditya Sarpotdar said the builder kept them in the dark about the affidavit submitted by him to the PMC, taking responsibility for supplying water to the complex. They are, therefore, planning to move the consumer court against the Kataria and file a cheating case against him.

    The PMC water supply amounts to barely 30,000 litres per day, as against the society's requirement of nearly 1.80 lakh litres per day. The residents are thus forced to depend on water tankers. "The cost of water works out to Rs800 per tanker. Everyday our housing complex needs about 14 water tankers and the daily bill amounts to Rs10,000. The water demand shoots up during festivals," Dhakane said.

    Residents said they discovered the 'water affidavit' after repeatedly complaining to the PMC. They said, the builder has been refusing to allow the formation of a housing society till the residents agree to take responsibility for water supply.

    Apartment owners also alleged that the developer had not provided all amenities, as promised. They said that since the PMC had given its approval for the society and they were paying water tax regularly, it was the municipality's responsibility to ensure proper water supply.

    Resident Sakshi Mahale said, "Though we are paying water tax, the society is not getting enough water. There are no separate tanks for the PMC water and water from the tankers. Both waters mix in one common tank. There is doubt about the quality of water from the tankers."

    Meanwhile, the PMC on August 10 issued a 'stop work' order to Kataria and architect Dilip Kale. The builder and architect had submitted an affidavit to the PMC stating that they would take responsibility of water supply in the project.

    The affidavit was submitted while seeking the PMC's sanction for their plan. Since they have defaulted on their promise, the building control department has issued the 'stop work' order, preventing them from proceeding on ongoing construction activity in the complex.

      This is why I keep saying legal agreements are as important as rate. We bought in AGC 4 years ago during pre launch, when there was no other option. Rates were going up daily.
      Unfortunately for us, the water nightmare was lurking in the shadows, we got a cheap rate, but we also got a cheapo builder.

        Abeer, I have all sympathies for you all there...BTW, at what rate currently the flats sell there? Catch one BAKARA and cut it I mean cut the deal and exit...

          This is an excerpt from today's Pune Mirror.
          After all the hard work from AGC residents to escalate this issue in the media on all possible fronts (TV channels, print media), finally some good news is on the way. Good job AGC residents!

          Following Pune Mirror’s story about how the residents of Aditya Gar-den City in Warje were paying through their noses for drinking water, water tax to the Pune Municipal Corporation (PMC) and usage of water, the PMC has now prepared a water distribution line plan for the area.
          But for the time being PMC is carrying out a valve management system on an experimental basis.
          The residents of this area pay water tax to PMC. They also pay for 60 tankers daily, buy mineral water for Rs 600 per month per family which amounts to a whopping Rs 57.6 lakh annually.
          They even approached the PMC with this issue, but to no avail.
          PMC had already allocated Rs 38 lakh in 2010-11 budget, but it was only a budgetary provision for new water distribution lines. It is only after Pune Mirror’s report that the PMC has made the water distribution lines plan.
          YG Deshmukh, Executive Engineer of Water Supply Department of PMC for Warje area said, “Currently, the PMC water supply line is upto Cipla Hospital, which we will extend up to Aditya Garden City under the Express Way.
          We have made a plan for water distribution lines. The tender is ready and it will come before the standing committee within next 15 days. Till then we will provide water to the resi-dents using valve management.”

            Man, providing PMC water doesn't really depend on PMC but the builder. If he has the clout, PMC will come immediately after project is complete, if builder is some junk like Kataria of Aditya, nothing will happen. See even his projects like Comfort Zone, Balewadi has no PMC line.
