      Unauthorised structures razed in Cidco, Nashik West

      Unauthorized construction of a 50 feet compound of Sudam Narayan Wani was demolished at Survey No 3/2/plot no 9 C, Suvarna Housing Society at CIDCO.

      NASHIK: The encroachment department on Wednesday morning bulldozed unauthorized constructions in CIDCO (New Nashik) and Nashik West, in continuation of the drive launched recently. CIDCO division is known to have maximum unauthorized structures.

      Unauthorized construction of a 50 feet compound of Sudam Narayan Wani was demolished at Survey No 3/2/plot no 9 C, Suvarna Housing Society at CIDCO. In gaothan area of West Nashik, unauthorized construction at Gangadarshan Apartment was removed by the owner Govind Hari Vaishampayan. At Saraf Bazaar, the owner removed the unauthorized platform constructed in house no 655 near Okachi Taalim.

      Divisional officer of CIDCO RR Gosavi and Nitin Ner of Nashik West were present along with three squads with vehicles and one earthmover for the anti-encroachment drive.

      "We have been notifying people through public notices to remove all the unauthorized structures. If they don't remove it on their own, then we have to demolish it. All the unauthorized structures that are by the roadside and are blocking traffic or occupying parking space will be removed on priority. CIDCO area has the most number of unauthorized structures," said an NMC official.

      He added that they had notified the owners concerned as per the norm and had given them time to remove the unauthorized structures before the NMC began with the demolition drive.

        Consumer cases rise in Nashik, mostly builders in the dock

        The official said this year's trend shows an increase in the number of cases as against last year's.

        NASHIK: The Nashik Consumer Forum has witnessed filing of 419 cases till the June 2016 - and on top of the chart are the grievances against the builders at 108. A consumer court official said 2015 had seen 674 complaints.

        The official said this year's trend shows an increase in the number of cases as against last year's. He attributed the trend to the increasing awareness among the consumers.

        "The sector that has seen most people complaining of being cheated is the real estate where the people are cheated is the real estate - 108 cases in the first six months only show the agony among the consumers," the official said.

        "The consumers have already paid some hefty sums to the builders and the banks have started recovering the amount. But the consumers are still awaiting property possession and, at the same time, are paying rents. Why will not they feel disturbed? This is where the consumer forum comes into the picture. While it takes due timing for hearing of the case and delivering of the judgment, the consumers are satisfied at the end," an officer from the registrar's office of the consumer forum said.

        The "best part" of the forum is that nowhere in the legal parlance, the consumers or the customers can defend their own cases.

        "There is no provision in any of the courts to provide compensation for mental harassment. At the same time it may be noted that the decision is taken by a three- or at least two-member bench - one president and two members. There is no chance of a unilateral decision at all," the officer added.

        "The insurance sector has been the second major area where consumers have sought help from consumer forum and it may be pointed out that almost 99% of the cases were judged in favour of the consumers or customers," the officer said.

        Most of the people complaining against the insurance sector are the farmers, whose Rs 1 lakh insurance was not cleared by the insurers on some or the other pretext. The judgments by the various superior courts have already clarified the manners in which the insurance claims should be settled as the aim of the insurance is to relieve the family members and not hold them to ransom for any cause.

        "The common example is a farmer - who is covered under the insurance scheme - dies in a road accident and does not have a licence. The companies reject the claim, saying he does not have a licence. But the Supreme Court itself has passed a judgment saying in case the victim does not have licence, then the family should not suffer and the insurance claim should be settled. But this is still not happening and hence the rise in the number of cases," the registrar's office of the consumer forum said.

          Nashik civic body to float third bid to conduct property survey

          NASHIK: The lack of response to tenders has further delayed the survey of property in the city by a private agency, prompting the civic body to float bids for the third time.

          The Nashik Municipal Corporation (NMC) had floated tenders to conduct the survey and recover maximum property tax. But there was no response as the minimum rate quoted by an agency was 48.50% more than the NMC's rate. The tenders were invited again but there was no response for the second time, too. Under such circumstances, the NMC has now prepared the third proposal.

          The NMC has a record of 4,15,744 properties in the city. Taking into account that the city with a population of 17.5 lakh should have at least five lakh properties, the civic body decided to conduct the survey through private agencies.

          The survey was supposed to begin in June-July. But after the tenders were opened, only three agencies qualified for the bidding and the minimum quotation was found 48.50% more than what the NMC had quoted. It had requested the agency to reduce its price. The agency, however, slashed the price by only Rs 4. After negotiating, the quotation was brought down. But it was still 43% more than the NMC rate.

          "Three agencies responded the first time, while there was no response the second time. We will inviting the tender once again," deputy municipal commissioner Rohidas Dorkulkar said.

          The last property survey in the city was done in 1999. In 2012, the then municipal commissioner had planned to carry out a complete property survey of the city. The plan saw no progress as the official was transferred.

          In the meantime, water reading by a private agency will have to wait for some more time as the administration is awaiting the resolution of the general body. The private agency will check the faulty meters and replace those.

          "The proposal to appoint a private agency for water meter reading was raised at the general body meeting. We are waiting for the resolution, after which we can float the tender. The agency will not only read the water meters but will also replace the non-functioning ones," Dorkulkar said.

            MUMBAI: In a major relief to Mumbai Educational Trust founded by NCP leader Chhagan Bhujbal, the Bombay high court on Friday set aside an order of the state government about taking back land allotted in Nashik for the Govardhan campus.

            Justice S C Gupte set aside the order saying it lacked application of mind. The land was allotted in 2009 to MET where the Bhujbals are trustees. It was allotted and meant to be used for educational purposes within two years. Since it was not put to use, in 2012 the collector filed a report leading eventually to a show-cause notice to the MET for why the land ought not to be taken back. MET moved the HC to challenge an order of May 30, 2016 passed by the revenue minister for cancellation of allotment and for return of land, saying it was without jurisdiction.

            Senior counsel Aspi Chinoy and Prasad Dhakephalkar pointed out to the HC that the trust had taken steps to utilise the land for educational purposes and had also sought an extension from the state. The trust argued there were encroachments on the land which it removed and now the institution's building already stands constructed. Advocate Sajal Yadav, who also represented the trust, said in 2006 MET set up the Nashik city campus at Adgaon. Pankaj Bhujbal one of the trustees said, "We have full faith in the judiciary.''

              Over 1,600 flats unsold in Nashik: Credai
              Around 8,500 flats are under construction across the city, according to a primary survey conducted by the Confederation of Real Estate Developers' Association of India (Credai), Nashik.

              NASHIK: Around 8,500 flats are under construction across the city, according to a primary survey conducted by the Confederation of Real Estate Developers' Association of India (Credai), Nashik.

              The survey also revealed that 1,687 ready flats are unsold.

              Credai conducted a survey of vacant and under-construction flats in a bid to have the actual data of supply in the city. The association has 258 members, of which the survey of properties by 50 builders has been completed.

              Sources in the Credai said, "Of the total flats under construction, around 5,500 are by six big builders. The other 3,000 under-construction flats are by 44 builders." Market sources said that close to 3,000 ready flats worth Rs 900 crore are lying vacant or unsold.

                Nashik forms SPV for smart city
                Elected representatives of NMC had rejected SPV as suggested by the government since they were not included in it.

                NASHIK: Special purpose vehicle (SPV), which is mandatory for the Central Government's Smart City scheme, has been formed by Nashik Municipal Corporation (NMC) after lot of hitches in the initial stages.

                Elected representatives of NMC had rejected SPV as suggested by the government since they were not included in it. Being an independent committee, there was no NMC member in it. Corporators had rejected the government's SPV saying that it would snatch away the rights of 127 members of the general body and the standing committee.

                As per a general body resolution of NMC, elected representatives were also included and the proposal sent to the state government that approved of it.

                The SPV, Nashik Municipal Smart City Development Corporation Ltd (NMSCDCL) has 15 directors and Rajiv Gandhi Bhavan is the head quarter of the company.

                "The SPV is a public limited company with share capital of Rs 5 lakh. Chief secretary Sitaram Kunte represents the state government and is the chairman of the board of directors, district collector, municipal commissioner, commissioner of police and director of CIDCO are the directors. In a meeting at Mumbai on Wednesday, SPV was also discussed," said an NMC official.

                  I would just like to find out if there is a problem in obtaining the OC in Nashik, I have bought a property and got it registered in my name but still waiting for the OC for last 6 to 8 months, as per the builder there OC being issued to any builder and there are 4 to 5000 pending cases. If any one has any information please post.

                    I think still there is issue with clearance of KAPAT/wardrobe area ( 8*10) pending with government authorities,caused cc,oc prolems in nashik. Ask your builder about this.

                      I think still there is issue with clearance of KAPAT/wardrobe area ( 8*10) pending with government authorities,caused cc,oc prolems in nashik. Ask your builder about this.


                      Any chance of getting this resolved, what can be done to get this process going. How can help, really need to get the OC as the construction is ready since Feb.
