Would like to have 2 clarifications…
Problem#1:
The builder has given a possession certificate to stay in the apartment (located in Bangalore) in May 2007. As per the agreement with the landlord, the builder has agreed to provide DG set in the apartment. However till now (21st May'09) the builder has not yet installed. We have 2 lifts and many times people got trapped in the lift due to power failure. Also we have other pending tasks from the builder.
Totally there are 52 flats in the apartments (G+3 floors with basement parking), almost occupied. We have not yet registered an association even though there is a nine member committee as formed in the last apartment owners meeting. The committee members are not acting as discussed in the meeting and there is nobody to take responsibility. As such the builder is making use of the situation and not acting.
Please guide us what is the best option to act to get the pending tasks from the builder. Is there an option to go legally?
Problem #2:
In the same apartment the landlord is also staying and they have installed tele tower in the top terrace in agreement with a telecom company. The landlord is taking the monthly rent from the tele tower even though it is located in common area (terrace). Also the DG set for the tower is kept in the terrace and generating lot of noise and vibration in the building.
Please guide us what is the best option to act to get rid of the tele tower. Is there an option to go legally?

    u put your problem in consumercourt as soon as possible.
    As it is the only way out of it...........
    or try to talk to landlord for the teletower case
    Agar man jata hai to koi problem nai hai......
    if not dan definitely sue him...........

    It seems from your write up that you are a tenant. Personally, I would suggest you to move away to another place. Its your landlord... i.e. the owner of your flat, who actually has the power to decide, whether he wants a DG set or not, and what were the actually terms and conditions between him and the builder.

    So better find another place.
