MC member has covered and included common area into his flat is it legal

    One of our Housing society's committee memeber has covered and included common area into his flat. is it legal?

    When we went to sociey chairman he said society has sold it to him.



    We are confused. Want to know if such act by the society memeber is legal or not?

    If the managing comittee has sold the common area then there should be relevant resolutions duly passed, recorded and a registered sale deed to make a sale valid in law.

    Plus there should be relevant monetary trasscation in the books of the society.

    The chairman alone cannot sell common areas on behalf of the whole society
