I have take a flat in a new constructed apartment complex in Bangalore. After occupying the apartment to our dismay we found that builder has constructed two living rooms with attached toilet for his maid servants in the corner of the car park underneath the stilt area. His maid servants are currently living in that portion causing discomfort to all the residents.
While purchasing the flat the above construction was not a part of the main building plan. The stilt area was allocated for car parking. When we question this structure to our builder he in turn points out the following clause in our sale deed which is as follows.
"The purchaser / association are not entitled for any right for the constructed spaces/areas below the tank and at the stilt level, which are exclusively meant for the builders usage"
My question is can the builder construct such a structure in the car park area without the approval of the resident or the association? If this structure is illegal can you suggest any suitable remedies to overcome the above issue?
