I am from Ahmedabad , Mr.X have bought a Flat from bulider and the new flat possesion is in Sept , Mr.X have Made 15% payment to bulider from his pocket and Bank Have done 80% Payment from Mr.X Loan Account and 5% of payment is due at the time of Possesion and ther is a Non Registered agreement to sale ( Notaryised) and Sale Deed is not Done till now , and Mr.X want to Sale this Flat to me , How can it be done ?
You will have to go through a property lawyer to get all the documentation done. Since the property is not registered, you will have to now register it on your name through the builder. There will be a tri-party agreement between the seller, builder and buyer to carry out the transactioon. The lawyer will be able to guide you.
